TERMS AND CONDITIONS OF USE (TCU)

Article 1 - Purpose
These Terms and Conditions of Use (hereinafter the “TCU”) define the conditions governing access to and use of the Le Scénario AI platform (hereinafter the “Platform”).
The Platform is a digital clinical simulation service intended exclusively for educational and professional use.
Any use of the Platform implies full and unconditional acceptance of these TCU.
Article 2 - Legal Information
2.1 Publisher
The Platform is developed and operated by:

Hereinafter referred to as the “Publisher”.
2.2 Hosting
The Platform is hosted by compuute.io and/or by technical service providers selected by the Publisher, primarily located within the European Union.
Article 3 - Description of the Service
Le Scénario AI is a digital clinical simulation platform enabling:
- scenario-based interactive simulations,
- the use of artificial intelligence tools to generate simulated interactions,
- educational performance assessment,
- the production of analytics and feedback reports.
3.1 Educational Use Only
The Platform is intended exclusively for educational and training purposes.
It does not constitute:
- a medical device,
- a diagnostic support tool,
- a real-world clinical decision-making system,
- a substitute for professional medical advice.
No real medical decision shall be made on the basis of content generated by the Platform.
Article 4 - Access and License
Access to the Platform is subject to account creation and acceptance of these TCU.
The Publisher grants the Client and/or User a license that is:
- non-exclusive,
- non-transferable,
- time-limited,
- strictly governed by the applicable commercial agreement.
This license does not imply any transfer of intellectual property rights.
The Publisher may suspend or terminate access in the event of:
- non-payment,
- breach of the TCU,
- misuse or fraudulent use,
- or any legitimate reason.
Article 5 - Artificial Intelligence
The Platform integrates artificial intelligence technologies capable of generating automated content.
Such content may contain inaccuracies, approximations, or inconsistencies.
The User remains solely responsible for critically assessing and pedagogically using any generated content.
The Publisher does not guarantee the accuracy or completeness of content generated by artificial intelligence modules.
Article 6 - Intellectual Property
The Platform, including its source code, architecture, databases, interfaces, algorithms, and technical developments, is the exclusive property of compuute.io.
Clinical cases and educational content may belong:
- either to the Publisher,
- or to partner institutions,
- or to their respective authors.
Any reproduction, extraction, copying, distribution, resale, or unauthorized exploitation is strictly prohibited.
No implied transfer of rights results from the use of the Platform.
Article 7 - Personal Data
Personal data are processed in compliance with the GDPR and applicable French legislation.
Depending on the contractual arrangement, the Publisher may act:
- as a data controller,
- or as a data processor on behalf of a client institution.
Data are used exclusively for:
- operation of the service,
- improvement of the Platform,
- educational analysis,
- production of anonymized studies.
Users have the right of access, rectification, erasure, restriction, and portability by contacting: [email protected].
Article 8 - Liability
The Publisher makes reasonable efforts to ensure service availability and security.
However:
- the service is provided “as is”,
- no guarantee of uninterrupted operation is given,
- the Publisher shall not be liable for indirect damages.
The Publisher's total liability, for all causes combined, shall be limited to the amount effectively paid by the Client during the previous twelve (12) months.
The User is solely responsible for:
- their use of the Platform,
- decisions made based on generated content,
- compliance with applicable regulations.
Article 9 - Duration and Termination
These TCU take effect upon acceptance and remain applicable as long as the account remains active.
The Publisher may modify these TCU at any time.
The applicable version is the one in force at the date of access.
Article 10 - Governing Law and Jurisdiction
These Terms and Conditions of Use are governed by French law.
They shall be interpreted and enforced in accordance with the laws in force in France, excluding any conflict-of-law rules.
In the event of a dispute relating to the validity, interpretation, performance, or termination of these TCU, the parties agree to attempt an amicable resolution prior to initiating legal proceedings.
Failing amicable resolution within a reasonable period of time, the dispute shall be submitted to the competent courts within the jurisdiction of the Paris Court of Appeal.
